To Be An Effective Minister With Integrity, Datuk Seri Tengku Adnan Tengku Mansor Must Come Clean On His Role In The V.K. Lingam Judicial Appointments Scandal Where He Was Found By The Royal Commission of Inquiry to Have Conspired with Datuk VK Lingam and Tan Sri Vincent Tan to Subvert the Federal Constitution by Fixing the Appointment of Judges

Datuk Seri Tengku Adnan Tengku Mansor, having been found by a Royal Commission of Inquiry to have conspired with Datuk VK Lingam and Tan Sri Vincent Tan to subvert the Federal Constitution by fixing the appointment of judges must come clean of his role in conspiring with Lingam.

In September 2007, Malaysians were stunned by the release of an eight-minute recording of Datuk VK Lingam engaging in a telephone conversation with a senior judge, detailing a dishonest conspiracy to fix the appointment of senior judges in the Malaysian judiciary. In that eight-minute recording, the name of Tengku Adnan was mentioned no fewer than eleven times.

After lengthy hearings, the Royal Commission of Inquiry (RCI) into the scandal, headed by former Chief Judge of Malaya Tan Sri Haidar Mohd Noor, handed down its findings in May 2008. It held that VK Lingam, Tan Sri Vincent Tan and Tengku Adnan were all accomplices in a “nefarious exercise” to thwart the proper appointment of judges in accordance with the Federal Constitution.

The RCI found that the conspirators (including others such as Tun Eusoff Chin) had also schemed to ensure their “friends” were appointed to the judiciary. The RCI also found that Tengku Adnan, as Deputy Minister and later Minister in the Prime Minister’s Department, appeared to be the “fixer” within the Prime Minister’s Department who passed secret information relating to the appointment of judges to VK Lingam, in apparent breach of the Official Secrets Act 1972.

In response to Tengku Adnan’s denial of involvement, the RCI found that Tengku Adnan had in his sworn testimony been “too economical with the truth to be believed”. It held that Tengku Adnan had “not in the least degree” succeeded in disassociating himself from the video clip in which his name was mentioned eleven times.

The RCI also drew attention to the fact that Tengku Adnan had, as a Deputy Minister and Minister, sworn a solemn oath to “protect, preserve and defend” the Constitution of Malaysia, but had instead involved himself in a conspiracy to destroy the credibility of the institution of justice in Malaysia.

The RCI recommended that the VK Lingam and his conspirators be investigated by the Attorney General under the Penal Code, the Sedition Act 1948, the Legal Profession Act 1976 and the Official Secrets Act 1972, but until no action has been taken against those responsible.

It is clear that despite all that the Prime Minister, Datuk Seri Najib Tun Razak may claim, Malaysia cannot move on from the corruption and abuses of power of the Mahathir era while men such as Tengku Adnan who are implicated in some of the worst abuses of that time are appointed to high ministerial positions by Datuk Seri Najib. Tengku Adnan fully account for his role in the V.K. Lingam as a Malaysian Cabinet Minister must not only be clean but must also be seen to be clean.

东姑安南的名字被提及了不下11次。

在听证会后,以马来亚前首席大法官丹斯里海达为首的皇委会在2008年5月有了结果。皇委会显示林甘、陈志远及东姑安南共谋着“邪恶的行为”,阻扰根据宪法的法官委任程序。

皇委会发现这群阴谋策划者(包括敦尤索夫晋)也策划让他们的朋友获得委任成为法官。皇委会也发现东姑安南作为副部长及尔后的首相署部长,竟然是首相署当中将委任法官的机密,通风报信给林甘的人,违反了1972年的机密法令。

对于东姑安南否认牵涉其中,皇委会发现东姑安南宣誓后的供词“简单得太过让人难以相信”,皇委会也认为东姑安南“连最小程度”也不可能置身事外,因为短片中他的名字被提了11次。

皇委会也提醒东姑安南作为副部长及部长,是曾经宣誓“保护、维护及捍卫”马来西亚宪法,但是他却反过来以阴谋摧毁了马来西亚司法制度的公信。

皇委会建议林甘及其同谋应在刑事法典、1948年煽动法令、1976年法律专业法令及1972年官方机密法令下,由总检察长展开调查。但是截至目前为止,并未见当局展开任何行动对付有关的负责任单位。

很明显的,尽管首相拿督斯里纳吉称:马来西亚不能够再以敦马哈迪年代的贪污及滥权方向向前迈进,但是同一个时候,像东姑安南这种在那个时代牵涉到最严重侵权事件的人,却也被纳吉委任为高职位的内阁部长。作为需为VK 林甘事件负起全责的内阁部长东姑安南,他不只需要廉洁,也必需看起来是廉洁的。

NONEDua petisyen itu merujuk kepada video yang dimuat naik oleh Zahid sendiri dalam laman rasmi, yang menyebut beliau merekrut 24,000 penyokong BN yang juga pengundi tempatan di Badan Datoh, sebagai pekerja kempen ketika bertanding kerusi Parlimen itu.

Beliau juga dalam video itu mengakui memberikan mereka RM100 dan 5kg beras setiap seorang.

‘EC failed to check on double voting in Setiawangsa’

PKR candidate for Setiawangsa Ibrahim Yaacob has claimed in an election petition that the Election Commission (EC) had failed to check on the existence of double voting in the parliamentary constituency.

Setiawangsa is a parliamentary seat where the Defence Ministry and several army camps are located.

NONEIbrahim, who lost by 1,390 votes in the May 5 general election, also claimed in his election petition filed yesterday that there is duplication in that eight people having the same names were found in the postal voters list, and he went on further to list them.

In addition to this, Stream 4 in the early voting for army personnel showed that 650 people had cast their votes against 690 ballot papers which had been issued, and this raises questions about the remaining 40 ballot papers as stated in Form 14.

Similarly in Stream 8, there is a discrepancy as there is an excess of 41 ballot papers cast, whereas it is stated in the form that 650 people had cast their votes. He went on to list similar grouses in other streams.

Ibrahim further claimed that together with doubts over the performance of the indelible ink which can be washed off easily, this had resulted in the threat of double voting to be real.

A sudden storm disrupted but failed to stop the momentum of the #Black505 rally in Sungai Petani

Instead of rushing home, the majority of the crowd who came opted to stay and listen to Opposition icon Anwar Ibrahim and his Pakatan Rakyat colleagues talk about electoral fraud and get the latest update on the legal action Anwar and PR plan to institute against the Election Commission. The EC is widely perceived to have been guilty of helping Prime Minister Najib Razak’s Umno-BN coalition win the May 5 general election through unfair and dishonest means.

“We were expecting a big crowd, we prepared for that. The police and the authorities gave us good co-operation. We can plan but it is the One up there who decides. In fact, I actually had thought it might rain and tried to prepare for it. Thank God, we had a good hall and a good sound system. The people didn’t move off, they stayed put till the end and even after the rain stopped, they continued listening to the speeches of the leaders. This is something that really touches the heart. It is a marvelous spirit,” Johari Abdul, the MP for Sungei Petani, toldMalaysia Chronicle.

The rain came around 10pm, erupting suddenly and heavily. The people, who were seated on a large field, got to their feet almost in unison and in a wave-like motion, rushed for the makeshift stage built outside a covered hall.

Despite the large numbers – nearly 10,000 on the field – no one got hurt and the confusion lasted only briefly. Johari’s aides and team of volunteers seemed to know what to do and they responded quite swiftly. The situation was brought under control and within 10 minutes or so, the people were seated again albeit this time on the floor of the hall and ready to listen to more ceramahs or political lectures from the Pakatan leaders.

Key dates – 22nd, 23rd and 24th

Apart from Anwar and Johari, other Pakatan leaders who came for the Sungei Petani Black 505 rally were PAS deputy president Mohamad Sabu, DAP MP for Bukit Bendera Zairil Khir Johari, PKR vice president Tian Chua, Bukit Selambau assemblyman Dr R Krishnamoorthy and youth activist Badrul Hisham Shahrin aka Chegubard.

Buoyed by the huge public support for the Black 505 rallies, Pakatan leaders have minced no words attacking the Umno-BN for “stealing” their victory. They plan to hold a giant rally on June 22, where they are targeting a one-million crowd.

“Anything can happen on 22nd, 23rd and 24th (of June). We will be there (in Parliament for the oath-taking) on the 24th and also on the 25th (for the King’s speech). 22nd will be a big day where we will congregate at Padang Merbok – 505 – and we will probably begin at 12 noon,” said Johari.

“There are some who say they plan to stay overnight, camp there till 23rd, and then 24th will be the oath-taking. So this is the series of events that will take place. 22nd will be the big do. (On) 23rd, the people may want to stay and see how things are because they are expecting a lot of media to be there from all over the world, so they want to take advantage of these media and they may want to voice out their dissatisfaction over this minority government.”

In the May 5 election, the Umno-BN won 133 seats in the federal Parliament versus the Pakatan’s 89. But Anwar has refused to concede defeat, claiming large-scale vote-rigging and irregularities. The majority of Malaysia’s 13 million-odd electorate appear to believe him as the Pakatan had won 51% of the total votes cast and yet could lag behind the BN by as many as 44 seats in Parliament.

The 64-year-old Anwar began the Black 505 rallies to protest the alleged biased ballot. His coalition is demanding the resignations of the Election Commission chairman and deputy chairman. They also want re-elections in some 30 ‘dubious’ seats.

Some other moves begun by Pakatan to highlight their dissatisfaction over the outcome of the country’s 13th general election include the recent boycott of a parliamentary briefing.

This has prompted Pandikar Amin, the BN Speaker in the past parliamentary session, to warn that should the Pakatan leaders boycott the official oath-taking ceremony on June 24th, he would not allow them to be sworn in at another date. Pakatan leaders would then run the risk of being dropped as elected representatives, said Pandikar, who has since been roundly condemned for his “unlawful” and “unbecoming” threat.

Tuesday’s assembly in Sungei Petani is the 12th Black 505 rally. The next will be held on Wednesday in Kota Bahru, Kelantan, followed by another on June 16 at Batu Pahat, Johor. But it is the June 22 “big do”, which will be the most closely watched.

“Exactly like this, a peaceful assembly, but larger scale – a national event – to show Malaysians and the world we will not condone cheating,” Anwar had said, referring to the June 22 rally. He made it clear it was to be a peaceful assembly and not a street protest.

How to Set Up a Charity Foundation in Malaysia

What is the difference between forming a charitable trust under a living trust compared to forming a foundation under the Trustee Act 1952?

The senior General Manager from Rockwills, Mr. Azhar Iskandar Hew explained in this video.

Living Trust is pretty simple to set up because you do not need to get the approval of the authorities when you want to set up the trust. It’s a private arrangement you have with the trustee.

So, you draw up the papers and all that, then tell the trustee what you want to put inside this trust fund. So, the question is now: When do you want to activate this trust fund, upon death or during your lifetime?

Now, if you go with the Trustee Incorporation Act, in order to start up the trust fund, you will have to apply for licensing with the Prime Minister’s Department. You will need to provide whatever documentation they require which is usually the trust deed, application forms. The PM department also requires you to submit plans regarding what you want to do with the foundation in the future, your plans for the next twelve months if, let’s say, the license has been granted.

Keep in mind though, those plans that the PM’s department requires should be detailed, else they would think that you’re not serious about it. Though they don’t require guarantees in terms of how much you want to put in, they do ask for a proper plan. The Inland Revenue Board also will ask for a proper plan for them to grant the tax exemption license.

Now, what will happen is, you will apply to the PM’s Department to get approval first for all the paperwork. Once that is approved, it will probably take about six to eight months, sometimes even to a year.

Your next step will be after getting the approval from the PM’s Department, you will apply to Inland Revenue Board for a tax exemption license. That takes six to eight months.

Now, during this application, they will ask you: “From the time you got the PM’s Department license to your application today, what have you done in terms of the money that you are putting in to the foundation?” They want to see activities that have been done while you are waiting for approval from the IRB for the tax exemption.

That’s one reason. They want to look at your history, and at the same time, what they will tell you are you need to provide a plan for the next twelve months. If we grant you the license today, for the next twelve months, what are your detailed plans to use the funds?

They are pretty tight on that because they want to make sure that the approvals given are not going to be misused or used for money laundering purposes.

Also, when you have a center or foundation, it means you are really serious and into it. You need to spend time managing that foundation and treating it as if it is a company that you are involved in full time.

You can’t wash your hands off because you are the founder of that foundation. You will need to monitor the foundation’s activities because if anything is found wrong with the annual report, the PM’s Department and Inland Revenue will look for the founder and for the board of trustees in that foundation.

So, a foundation is for people who are serious in wanting to do charitable work. If you want a name only trust, I suggest you do a charitable trust, because that’s less cumbersome in terms of compliance.

Another difference is that a foundation can raise funds from the public but trusts cannot do that. Unless there are people who would willingly put money in to the trust. Somebody donates money in to your charitable trust, that’s fine, but you can’t have fund raising activities like Karaoko Singing contests… You can’t do all that. Your trust still has to be very much self-funded or on donations.

DAP expresses shock at the threat by outgoing Dewan Rakyat Speaker Tan Sri Pandikar Amin Mulia to boycott the swearing-in of PR MPs so that they will lose their eligibility as parliamentarians resulting in a by-election. Under Article 59(2) of the federal constitution, any elected representative who fails to take the oath within six months will be disqualified automatically and his or seat shall be vacant.

The role of the Speaker of the House is to conduct parliamentary business impartially and should not partake or interfere in political matters. It is most unbecoming of any Speaker and he has no right to boycott any parliamentarian or deliberately cause his or her disqualification by boycotting or refusing to swear him or her in. I hope that this is only a joke by Tan Sri Pandikar or else there will be serious doubts on his intentions and impartiality when he presides over Parliament.

DAP 38 MPs will neither boycott the Dewan Rakyat’s swearing-in ceremony of Members of Parliament on 24 June 2013 nor its parliamentary sittings but will use the legislative process to press for polls reform, particularly adhering to the democratic principle of “one-person, one-vote, one-value”. Boycotting the swearing-in of MPs will not be seen as a “symbolic gesture” or a bold step to protest against the stolen general elections when PR can make the point more effectively with nation-wide peaceful protest rallies.

For those who commit electoral fraud, will not be affected by a mere boycotting of a swearing-in ceremony as compared to the voices of the real people’s movement. DAP is adopting a 3-prong approach to press for electoral reforms and clean elections for a fair delineation of constituencies to respect the “one-person, one-vote, one-value” principle:-

1. Legal processs of challenging in courts those seats that BN won through fraud, vote-buying and manipulating voters list through phantom voters and “Bangla” non-citizens;

2. Political process of pressing for polls reforms in legislative assemblies, civil campaigns and international fora.

3. People process of conducting mass movement campaigns, only where necessary, to press for clean, free and fair elections.

Nothing highlights the injustice of unfair electoral process more than Putrajaya won by BN with only 16,000 voters as compared to Kapar with 150,000 voters won by PR. This follows PR losing the general elections despite winning a majority 51% of the popular vote whilst BN won the general elections with 60% of the parliamentary seats despite winning only a minority 47% of the popular vote. BN is clearly a minority government with a minority Cabinet that has lost both moral and political legitimacy to be the democratically-elected government in Malaysia.

Both BN and the Elections Commission(EC) must admit that this was the most unfair and dirtiest elections in history where even the promised indelible ink that was supposed to last at least 3 days could be easily washed off almost immediately. The present EC members must resign as they cannot be relied up to conduct a fair constituency delineation exercise.

Di bawah Perkara 59(2) Perlembagaan Persekutuan, mana-mana wakil rakyat yang gagal mengangkat sumpah dalam masa enam bulan akan hilang kelayakan secara automatik dan kerusinya akan dikosongkan.

Peranan Speaker Dewan Rakyat adalah untuk menguruskan hal ehwal Parlimen tanpa berpihak dan tidak sepatutnya masuk campur dalam hal ehwal politik. Sangat tidak sesuai bagi seorang Speaker, dan beliau juga tidak ada hak untuk memboikot mana-mana Ahli Parlimen atau dengan sengaja menyebabkan seseorang hilang kelayakan dengan memboikot atau enggan menerima angkat sumpah. Saya harap ini hanya gurauan oleh Tan Sri Pandikar, jika tidak pastilah timbul kesangsian yang amat serius terhadap niat dan sikap tidak berpihaknya apabila beliau mempengerusikan sidang Parlimen.

38 Ahli Parlimen DAP tidak akan memboikot majlis angkat sumpah Dewan Rakyat pada 24 Jun 2013 mahupun sidang-sidang parlimen, namun tetap akan menggunakan proses legislatif untuk mendesak reformasi pilihanraya, terutamanya dalam hal mematuhi prinsip demokratik ‘satu orang, satu undi, satu nilai’. Memboikot majlis angkat sumpah Ahli Parlimen tidak akan dilihat sebagai perbuatan simbolik atau langkah berani untuk memprotes keputusan pilihanraya yang telah dirompak apabila Pakatan Rakyat mampu menyatakan pendirian secara lebih berkesan melalui perhimpunan aman di seluruh negara.

Bagi mereka yang melakukan penipuan pilihanraya, mereka tidak akan terkesan dengan perbuatan memboikot majlis angkat sumpah itu sahaja, berbanding kesan daripada suara sebenar pergerakan rakyat. DAP akan menggunakan pendekatan tiga serangkai untuk mendesak reformasi pilihanraya yang adil dan bersih serta persempadanan kawasan secara adil demi menghormati prinsip ‘satu orang, satu undi, satu nilai:

1. Proses undang-undnag untuk mencabar kerusi yang dimenangi oleh BN melalui penipuan, beli undi dan manipulasi daftar pemilih dengan kehadiran pengundi hantu dan pengundi ‘Bangla’ yang bukan warganegara di Mahkamah;

2. Proses politik untuk mendesak reformasi pilihanraya di dewan-dewan legislatif, kempen awam dan forum antarabangsa.

3. Proses rakyat dengan melakukan pergerakan kempen massa, hanya apabila perlu untuk menuntuk pilihanraya yang bersih, bebas dan adil.

Tidak ada yang lebih memperjelaskan ketidakadilan sistem pilihanraya seperti kemenangan BN di Putrajaya dengan hanya 16,000 pengundi berbanding Kapar yang mempunyai 150,000 pengundi yang telah dimenangi Pakatan Rakyat. Ini diikuti kekalahan Pakatan Rakyat dalam PRU walaupun menang majoriti 51% undi popular sementara BN menang 60% kerusi parlimen padahal hanya memenangi bahagian minoriti undi popular sebanyak 47%. Jelas bahawa BN adalah sebuah kerajaan minoriti dengan Kabinet minoriti yang telah kehilangan kedua-dua keabsahana moral dan politik untuk menjadi kerajaan yang dilantik secara demokratik di Malaysia.

Kedua-dua BN dan Suruhanjaya Pilihan Raya (SPR) mesti mengakui bahawa ini adalah pilihan raya paling tidak adil dan kotor dalam sejarah apabila dakwat kekal yang dijanjikan kekal sekurang-kurangnya tiga hari pun boleh dibasuh bersih serta-merta. Ahli-ahli SPR mesti meletakkan jawatan memandangkan mereka tidak boleh diharap untuk melaksanakan persempadan kawasan secara adil dan saksama.

民主行动党秘书长及峇眼国会议员林冠英于2013年6月11日在吉隆坡发表的文告。

民主行动党对国会下议院候任议长丹斯里班迪卡阿敏恫言他可杯葛欲宣誓就职的民联国会议员,以让他们失去国会议员资格以制造补选的言论感到震惊。根据联邦宪法第59(2)条文,任何民选代议士在6个月内无法宣誓就职,将会被自动取消资格,其席位将会被取代。
国会议长的角色是不偏不倚维持国会秩序,不应参与及介入政治事宜。议长本身并没有权力杯葛国会议员欲宣誓的要求以让他或她失去国会议员资格,因为这是非常不得体的做法。我希望这只是丹斯里班迪卡再开玩笑,要不然当他主持国会的时候他的意图是否中立将会引起严重的质疑。

行动党38名国会议员将不会在2013年6月24日杯葛国会宣誓就职典礼及国会本身,但会透过司法程序为选举改革施压,特别是实践“一人、一票、一等值”的民主原则。杯葛国会议员的宣誓并不会被视作为抗议瓢窃大选的“标志性的运动”或重要一步,因为民联可以透过更多的全国性抗议集会达到更有效的施压。

对于那些选举舞弊的罪魁祸首,单以杯葛宣誓就职并不能对他们有任何影响,反而集结人民运动的呼声才能对他们有所影响。行动党为了选举改革及干净选举,以达致公平选举划分及“一人、一票、一等值”的原则,采取三管齐下的步骤:

1. 司法程序,在法庭挑战国阵透过选举舞弊、买票及透过幽灵选民、非公民的孟加拉人,混入选民册所获得的席位。

2. 政治程序,透过立法议会、公民运动及国际与论施压。

3. 人民程序,当有必要时举办大型人民运动,施压要求干净、自由及公平的选举。

当国阵在布城议席只以1万6000票就赢得此议席,反观民联却得以15万票赢得加埔议席,可见没有比这种不公平的选举,更加不公不义了。民联还得在赢取51%总得票率的情形下,让只赢取47%总得票率的国阵,赢取60%的国会议席。国阵很明显的就是一个代表少数内阁的少数政府。国阵已经是一个彻底失去道德及政治合法性的民选马来西亚政府。

国阵及选委会必须承认这是史上最不公平及最肮脏的选举,甚至连所承诺的3天不褪色墨水也可以在投票后马上轻易洗脱。现有的选委会成员必须辞职,因为已经不能依赖他们作出公平的选区划分。

You need fences to prevent your competitors from encroaching on your market share, your territory.

IP tools/IP rights are weapons that you would be looking at. These are the ammo, the weapon, and the fence that you would need in your business artillery.

Geetha from KASS International shared about how to monetize your business intellectual properties.

Of the different types of IP rights, we will focus on “Patents” first. Patent rights are given to an inventor for 20 years. These are exclusive rights to an invention in exchange for a public disclosure of the invention. An invention basically includes:

  • Products
  • Improvement to existing products
  • Process and method of manufacture
  • Improvement or modification to a process or method
  • New non-obvious use of a known product (mainly pharmaceutical or chemical industry).

To put it in layman’s term, it is the moment when there is a technological solution to a problem. Let’s say a mobile phone for instance. The mobile phone was created because of the difficulty of having to be constantly at home or to be at a payphone at a specific time.

Remember those days when mobile phones were not around? You are constantly planning ahead and telling your parents to pick you up from school at a certain time, or meet a friend at a coffee shop at a certain time. Now, it’s real time. So, there was a problem in the market, and that was the technology created to adjust to the problem. Mobile phones can be carried everywhere and you can reach anyone at any time.

There are various types of issues faced in any specific industry like, for example, the pharma industry, the rubber industry, etc. There are also improvements in products or processes, or new products or processes. When these new inventions or new improvements are created, the inventor can obtain exclusive rights for them for 20 years. In return, documentation has to be filed in the IP office of the country where they are obtaining rights.

All information provided to the government is basically a public disclosure of how the invention works. The reason for this is giving all the information and making it available to the public will enable any competitor or anyone to actually work on the invention based on the information given and to improve on it. That encourages a nation of innovation.

It is constant innovation due to public disclosure of previous patents. If the information or the patents are given to the government but not revealed, it is very difficult to improve on something unknown unless the product can be reversed-engineered in a very easy manner. That is why there needs to be a public disclosure of an invention.

In return, the inventor gets 20 years exclusive right to use the invention or to export the invention. What does this exclusive right mean? This means that you have sole rights to manufacture the product, make the product or create the process. No other party can do this. You can use the product or process, you can offer the product or the process for sale, and you can import the product because you have rights in the country that it’s protected in, or you can export the product.

Exporting the product means you can manufacture in the country you’re protected in, but whether you can export it to another country, again, depends on whether you have rights there or if someone else has rights in the other country because patents are territorial. IP rights are on a country-by-country basis. So, if you have a product or technology and you want to have it protected, you have to look at the market that you would like to export to. That’s what it means by patents being territorial.

Rafizi shows proof Padang Merbok available for June 22 rally

PKR’s Rafizi Ramli revealed today that no event has been scheduled to take place at Padang Merbok this June 22, suggesting inaccuracy in KL Mayor Datuk Ahmad Phesal Talib’s claim that the venue would not be unavailable for Pakatan Rakyat’s #Black505 rally.

The PKR strategy director said he personally investigated Ahmad’s claim yesterday and discovered that the McDonald’s Olympic Run by the Olympic Council of Malaysia (OCM) is scheduled to take place on June 23 at Dataran Merdeka and not Padang Merbok.

“I checked the MOM Facebook page for further information about the run,” he said in a statement here, referring to the OCM’s Malay acronym.

 “Discovered that the run was not taking place at Padang Merbok but will start and finish at Dataran Merdeka,” he added.

The Pandan MP said his probe did not stop there.

To make sure that the event was really to be held at the historic independence square, he said he even checked the website of the Pacesetters Athletic Club Malaysia (PACM), which is participating in the run.

At the club’s website, Rafizi said it was confirmed that the event would be held at Dataran Merdeka, not at Padang Merbok.

“Finally, I checked the run’s route map from the registration form. Based on the route, it was clear that the run would not use Padang Merbok but will start and end at Dataran Merdeka,” he said.

Rafizi expressed disappoinment at the KL City Hall (DBKL) for its “inaccurate” statement on the use of Padang Merbok on June 23, saying it appeared as if City Hall was bowing to political pressure from Umno and Barisan Nasional (BN).

He said from his probe it was clear that Padang Merbok would be available for PR’s #Black505 rally on June 22.

At a press conference yesterday, Ahmad had urged PR to select another venue for the rally, preferably a closed-door area like a stadium, claiming the field would be needed for “logistic preparations” for OCM’s June 23 event.

The mayor also said holding the rally at the open, public venue would pose traffic concerns for motorists travelling along Jalan Parlimen, Jalan Kuching, Jalan Sultan Hishamuddin, Jalan Raja Laut, Jalan Raja and Jalan Tuanku Abdul Rahman.

He also said DBKL would not permit PR’s rally as it needs to “protect” the landscape along Jalan Parlimen which, he said, is a “protocol road” that has been decorated with beautiful landscaping.

But Rafizi disagreed with all of Ahmad’s concerns.

He said if the assertion by Umno and BN that peaceful gatherings should only be held in closed areas and not open, public spaces, the Peaceful Assembly Act should be changed to the “Peaceful Assembly in Stadiums Act”.

He disagreed that holding rallies in stadiums would be more convenient for petty traders, pointing to the limited space at these venues.

Rafizi also said it made no sense to reject PR’s rally bid to “protect” the landscaping along Jalan Parlimen, pointing out that the McDonald’s Olympic Run covers an even bigger area and goes through areas near Parliament building.

He said traffic concerns should be used as a reason to reject the event as the run would lead to road closures in several areas.

“If the authorities can close the roads to facilitate the run, I am sure they can do the same for the #Black505 rally on June 22,” he said.

Rafizi added that PR leaders will attend a meeting with Ahmad at 8am on June 14 but will not budge from its decision to stage the rally at Padang Merbok on June 22.

“What more now that there is proof that the field will not be used on that Saturday and Sunday,” he said.

Record crowd packs Perlis Black 505 rally: Calls for EC top duo to quit resound!

Malaysia’s smallest and northern-most state Perlis saw its largest-ever political rally on Monday night, with some 10,000 people packing the Pakatan Rakyat’s Black 505 gathering in downtown Kangar to greet Opposition icon Anwar Ibrahim, PAS deputy chief Mohamad Sabu and a host of other leaders who had trekked up the country to rally public support for their fight against electoral cheating in the recently concluded May 5 ballot.

“We continue with our fight. As I have said, the general election is not over. We are now exposing one electoral fraud after another,” the 64-year-old Anwar told the roaring crowd.

“We have to make a stand. Enough is enough.”

‘Penipuan’ (Cheating)

Monday’s rally was the first-ever Black 505 gathering held by the Pakatan in Perlis and the folk here were not disappointed. Many had come to see for themselves what has been variously described as being “a social wave”, “a phenomenon”, “a political awakening” overtaking the country.

The Black 505 rallies – the brainchild of Anwar himself – has drawn mammoth crowds all over the country. Malaysians of all races have taken part in these assemblies with gusto, abandoning their customary shyness to call out voraciously for the resignations of Prime Minister Najib Razak and the top officials of the Election Commission for allegedly cheating in the country’s 13th general election.

In Kangar, where the 11th Black 505 rally was held, it was no different. The crowd’s enthusiasm was obvious despite it being a Monday night. ”Penipuan” was the the most common response when Malaysia Chronicle asked several members of the audience why they had come to the rally.

“Inilah satu petanda orang Malaysia sudah sampai satu tahap politik yang matang (It is a sign Malaysians have become politically more matured),” was another common response.

Sustaining power, not ego trip but a fight for the very foundation of democracy

As usual, Anwar was mobbed by the crowd who rushed to greet him when he arrived, reaching out to touch him as he was made his way to the stage. Like it or not, his popularity and ability to mobilize public support is undeniable and unprecedented in Malaysian politics.

The success of the Black 505 in Kangar flies in the face of Pakatan’s critics, namely Umno, its newspapers and related news portals. The latter, in particular, have been vocal in their criticism that it was a waste of time, that the rallies were a mere puff for Anwar’s ego but a drag on public resources and time as well as being a red light for foreign investors.

Whether or not, they are speaking at the behest of their political bosses, the Umno-linked media and online portals have claimed that the Black 505 rallies were ‘not what the Malaysian people want from their Opposition’.

What do Malaysians want of their Opposition then, if not to fight for the most basic fundamental – a cleaned-up polls system that would ensure who got the greatest votes became the government as desired by the most number of people? Otherwise, how could the Opposition ever become the government and translate into action the policies they envisioned and promised the people?

Pakatan leaders, in rebutting the claims against them, point to the massive crowds that keep coming back for more. They point to the 51% of the Malaysian people who voted for them but were denied of a Pakatan federal government due to the electoral fraud, which includes widespread gerrymandering.

In their speeches, Anwar, Mat Sabu, PKR vice president Tian Chua and MP for Sungai Petani Johari Abdul all made it clear that Black 505 will continue until the Election Commission chairman and deputy chairman stood down and re-elections held in the seats where evidence of fraud had been found and were the strongest.

Those would be the first essential steps for the people to reclaim their ownership of the electoral system, which unless is reformed, would ensure that Umno-BN remained in power in perpetuity, the Pakatan leaders said.

“Today Kangar, tomorrow Sungei Petani and the day after Kota Bahru and on the 16th Batu Pahat,” Anwar announced.

“And on the 22nd June, a major rally in Kuala Lumpur. Exactly like this, a peaceful assembly, but larger scale – a national event – to show Malaysians and the world we will not condone cheating.”

Ada orang nak ‘bunuh’ Zahid: Dr M out to destroy Zahid?

Mat Sabu, who is in the process of completing a post-mortem of his own party’s performance in the general election, promised transparency and offered re-elections to Umno-BN in Pakatan-won seats so long as they showed proof.

“Yes, we hear what Umno is saying about our reps who have been sworn-in in Penang and Kelantan. Sure, if you (Umno-BN) have proof, show and you can also request for re-elections,” said Mat Sabu, who together with Tian received loud applause for their oratorical skills.

Youth activist Badrul Hisham Shaharin aka Chegubard, who heads the Solidariti Anak Muda Malaysia, was another popular speaker.

The 35-year-old had the crowd clearly on his side as he rattled through the list of reasons why Malaysians must stand up to the polls fraud he claimed had been perpetuated by the Umno -BN..

Chegubard also had the crowd in stitches with his witty remarks and the way he regained his poise after flubbing a line meant to attack former premier Mahathir Mohamad.

“Ini bukan kubu Umno, ini kubur Umno (this is not Umno’s fortress but Umno’s grave),” said Chegubard.

He repeated his warning to Home Minister Zahid Hamidi to be careful of Najib and Mahathir, whom he claimed were out for Zahid’s ‘blood’.

“Zahid, you are actually a leader with charisma but you are being trapped by Najib and Mahathir,” said Chegubard, referring to the intensifying infighting in Umno ahead of its internal polls due to be held later this year.

“Mahathir wants to ‘bunuh’ (destroy) Zahid so that his son can take over,” he added.

Krabi Day 2: The Island Hopping

The sun dawns early in Krabi. The day got hotter as it peaked 7 am. We were already strap to the breakfast table, getting a head start to a beautiful island hopping trip. Our trip was scheduled at 830 am for hotel pick up.

Initially we wanted to take a boat to Phi Phi Island but soon realized it’s an island where you need to stay overnight to experience it. So we decided to take the trip to Hong Island. The first place we went to does not accept pregnant woman as passenger. We attempted the second one after hours of wandering around. They took us at a reasonable price and we could only take the longtail boat.

The price for the trip is 600 Baht per person, the peak season price tag is at 1000 Baht. The key to negotiate is half it and negotiate up. Anyway, this price includes, snorkeling gear, lunch, drinking water, insurance, hotel transfers  etc, in short you don’t need to carry any money with you. My take, don’t negotiate too much, it’s already dirt cheap.

Everyone has to climb on the boat. So those who still young and strong, this is your time to be helpful. Elderly people, woman and kids would require assistance. Try to pack light and with waterproof bag. Everyone gets wet trying to board the boat.

Daeng Island. It doesn’t appear to have a jetty.

Our first island stop was Daeng Island. I was the first to jump off the boat. To be honest, I am scared swimming in deep waters, but I had to overcome my fears before it consumes me. We did a few minutes snorkeling in the area. The fishes we ‘too friendly’. When we stood idle, they’d swim close and sometimes rub their fins. Only adults are allowed to snorkel near this island.

Next up is Hong Island. This is an orgasmic island. The sand is so smooth and the water is relatively clear. It could’ve been clearer if not for the rainy weather which stirred dust and shells.

The was already peaked at this time of day. It was hot. Thankfully the water was cold.

We could easily spot fishes near the beach. The fishes like the ones at Daeng Island were tad too friendly. We had fun feeding the fish. To some extend, they were a little aggressive, biting everything in their way, including my finger and camera.

Before we head for lunch, we stopped by this area. I have no idea what’s it called, but the views were mesmeric.

Finally lunch at Paradise Island. This secluded and small beach was to me, the highlight of the trip. Perfectly shaded from harsh sun ray, traps the cool breeze and unpolluted beach.

The swing that chaired us for lunch. Makan tengah hari sambil berbuai di tepi pantai… ahhh bliss! There’s no feeling in the world that can replace that.

Lunch is Halal and Thais really give a damn about that. The company that we took is called ‘Barracudas Tour’ and the owner is a Muslim. They provide halal food.

Our day ended when we head back to the big land. They had to take us back sooner because of the high tide that normally starts at 4 pm. The boat ride home took about 1 hour to reach Aonang.

We wanted to repeat the experience next day to a different island, no company wanted to take us in. We thank Allah for giving us the opportunity to take a break from the mainland and hectic life. Hopefully one day, we’ll be able to revisit these island with Iman and gang.

Medicalc for iPhone – free for a limited time

Don’t we love free apps! Personally I have been a long time user of Medcalc ever since the PalmOS days, and currently what’s on my iPhone is Medcalc Pro which is no longer free but $4.99 on iTunes – still worth it IMO. Medcalc Pro however lacks Haematology modules (and only has a smattering of Oncology ones) so I was interested to come across Medicalc for iPhone as it contains HemeOnc modules, and it is free for a limited time on iTunes (download link)

I find Medicalc okay though the interface is not as slick as Medcalc Pro (which also gives you the ability to store patient data as well as favorites – both missing in Medicalc). Nevertheless it is chock-a-block with searchable formulae. The Hemeonc module is also sparse but covers more ground than MedcalcPro for hematology. (PS if you need more hemonc modules you can always check out my OncoPDA web apps)

To get the ip address use “ip” tool instead.

If you really want ifconfig back then grab the “net-tools from the AUR.

I Have Been Busy...

I recalled my last post was on Mother's Day...it has been that long huh. So what had happened to me in 20 days? Nothing much...I have been too busy with my real life...so much so that I have neglected this virtual persona that I created a long, long time ago. Besides my family, my hands are full with my company celebrating our 100th Anniversary this year. I have always wanted to write a line or two on this blog...but somehow I just couldn't get that right timing to do so...let alone motivation. However today I made up my mind to blurt out something so that I won't cut off from this virtual world that I have been "indulging" in.

I did not forget that I am still a blogger.

So how are you guys lately (referring to my blogging friends)? I guess you guys are still the same old, brand new you huh-blogging like usual. I wish I could do the same but...time factor aside, yours truly really lacked the passion and enthusiasm that could bring me to overdrive. I used to blog very frequently...at MY VERY OWN expense. In the past I have compromised my sleep and use my limited time to blog...because when my wife and babies are awake I want to spend my time with them. But...I know I'm a nocturnal creature...

Sure, blogging earns me a few hundred bucks per month, but I still prefer to do a good "job" in juggling my real world before handling both in tandem. To me, family is everything. After all nothing matters once you are "disconnected". So when will I return again...I don't know. Anyway take care everyone. :)

PKR: Zahid spent over RM200k while campaigning

Home Minister Ahmad Zahid Hamidi violated the Election Offences Act 1954 by spending more than the ceiling sum of RM200,000 in his campaigning during the 13th general election, PKR has alleged.

“There is a video circulating (on the Internet) that shows Zahid saying that he gave RM100 and a 5kg bag of rice to 24,000 people in Bagan Datoh,” PKR director of strategy Rafizi Ramli said today.

At a press conference at party headquarters in Petaling Jaya, Rafizi said according to his calculation, the expenses for that one act of largess alone would be more than RM200,000.

This, he claimed, was a violation of the rules for candidates in the Election Offences Act.

Based on this, PKR will file an election petition this week.

Rafizi said he would reveal the related evidence linked to this petition – and others – at a press conference on Wednesday.

PKR has signalled its intention to file 18 more petitions, while Pakatan will file 35 in all.

Malaysiakini has not been able to locate the video or to contact the minister or his aides for comment on this PKR allegation.

Pakatan Rakyat telah memberikan notis untuk mengadakan perhimpunan aman #black505 di Padang Merbok yang mulanya dijadualkan pada 15 Jun 2013 dalam tempoh 10 hari seperti yang dituntut oleh pihak berkuasa. Penganjur juga menerima nasihat kepimpinan Polis Diraja Malaysia (PDRM) untuk tidak mengadakannya di Dataran Merdeka, walaupun itu adalah tempat perhimpunan yang dituntut oleh banyak pihak.

Saya mengambil kira rayuan pihak-pihak yang telah pun mempunyai perancangan program di Padang Merbok pada 15 Jun 2013. Setelah berbincang dengan IPD Dang Wangi, penganjur membuat keputusan untuk menukar tarikh perhimpunan aman #black505 Padang Merbok ke minggu yang seterusnya iaitu pada 22 Jun 2013 bermula jam 12 tengahari.

Permohonan kepada DBKL untuk menggunakan Padang Merbok pada 22 Jun 2013 telah pun dibuat pada hari Jumaat 7 Jun 2013, iaitu 2 hari selepas permohonan pertama dibuat. DBKL juga telah mengesahkan bahawa semasa permohonan dibuat pada 7 Jun 2013, tidak ada mana-mana pihak yang membuat permohonan mengadakan acara di Padang Merbok pada 22 Jun 2013.

Oleh itu, tidak ada lagi alasan untuk DBKL dan Menteri Wilayah Persekutuan bermain politik dengan melengah-lengahkan permohonan ini. Saya ingin mengingatkan Menteri Wilayah Persekutuan bahawa majoriti besar rakyat di Wilayah Persekutuan bersama-sama Pakatan Rakyat dan beliau perlulah menghormati hasrat rakyat Wilayah Persekutuan yang mahu berhimpun secara aman di Padang Merbok yang merupakan padang milik rakyat.

Notis kepada IPD Dang Wangi akan dibuat esok dalam tempoh 10 hari seperti yang dituntut oleh PDRM.

Ini adalah ketetapan akhir dan tidak akan ada sebarang perubahan selepas ini tidak kira apa alasan yang diberikan oleh DBKL.

Perhimpunan aman #black505 akan diadakan pada tarikh 22 Jun 2013 (Sabtu) bermula jam 12 tengahari di Padang Merbok. Rakyat Malaysia yang cintakan kebenaran dan menolak penipuan pilihanraya diseru turun beramai-ramai untuk menuntut 3 perkara:

1.       Keseluruhan ahli SPR meletakkan jawatan serta-merta dan ahli-ahli SPR yang baru akan dilantik secara bersama dengan Pakatan Rakyat dan kumpulan civil society yang mewakili rakyat;

2.      Pilihanraya semula di 30 kawasan Parlimen bila mana dibuktikan berlaku penyelewengan;

3.      Hentikan sebarang usaha untuk meminda undang-undang pilihanraya atau persempadanan semula sehinggalah ahli-ahli SPR baru yang adil dilantik secara bersama seperti tuntutan (1)

Selain 24 kerusi Parlimen ini, Pakatan Rakyat juga memfailkan 10 petisyen pilihanraya bagi kerusi DUN di seluruh negara (9 DUN yang ditandingi PAS dan 1 DUN yang ditandingi PKR).

Serentak dengan petisyen-petisyen ini, PKR juga akan memfailkan tindakan undang-undang berikut dalam tempoh 3 minggu dari sekarang:

1.      Saman terhadap Pengerusi SPR, Timbalan Pengerusi SPR dan ahli-ahli SPR diatas kegagalan melaksanakan dakwat kekal;

2.      Petisyen pilihanraya menuntut mahkamah menyemak senarai pengundi yang dicemari pengundi hantu di Sabah berdasarkan keterangan yang dibuat di Suruhanjaya Diraja setakat ini dan kajian dalaman PKR;

3.      Tindakan undang-undang bagi mengisytiharkan pindaan Seksyen 9A yang menghalang kesahihan daftar undi dicabar dimahkamah bertentangan (ultra vires) dengan Perlembangan. Pasukan PKR yang akan memulakan tindakan undang-undang ini akan diketuai oleh Prof Dr Aziz Bari, pakar perlembagaan.
