Necessity Of Establishing The IPCMC Has International Relevance Following The Death Of A Japanese Detainee (en/cn)

Press Statement By DAP Secretary-General And MP For Bagan Lim Guan Eng In Penang On 9.6.2013.

Necessity Of Establishing The Independent Police Complaints and Misconduct Commission (IPCMC) Has International Relevance Following The Death Of A Japanese Detainee In Order To Gain Public Confidence That There Are No Abuses Of Power Or Torture In Custodial Deaths.

The necessity to establish the Independent Police Complaints and Misconduct Commission (IPCMC) has international relevance following the death of a Japanese detainee in order to gain public confidence that there are no abuses of power or torture in custodial deaths. The death of aJapanese man who was found hanged at the grille of his lock-up cell at a Subang Jaya police station early Saturday, is the fourth custodial death in 2 weeks.

This international dimension of the tragedy of custodial deaths prevalent in Malaysia has clearly tarnished Malayisa’s international reputation and smeared the image of Malaysia’s police force, new Inspector General of Police Tan Sri Khalid Abu Bakar and Home Minister Datuk Seri Ahmad Zahid Hamidi.

Selangor deputy police chief Datuk A.Thaiveegan said an autopsy report issued by the Universiti Malaya Medical Centre found that the 33-year old Japanese detainee, Nobuhiro Matsushita, died as a result of hanging and that there were no injures on his body. Whatever the cause of death, the police has to come clean on these prevalent custodial deaths and fully explain how these detainees can die either by their own hand or by the very policemen meant to protect them.

How many more must die before the tragedy of custodial deaths are stopped? Only the establishment of an Independent Police Complaints and Misconduct Commission (IPCMC) can prevent needless custodial deaths and it would be very sad that a Japanese detainee must die in police custody before moving the BN Federal government to act. This latest fourth death in 2 weeks follows the 3 earlier deaths of:-
• Karuna Nithi’s Tampin police lock-up on 4 June,
• R James Ramesh in a Penang police lockup on May 26; and
• the brutal killing of N Dhamendran with 52 injuries, while in a KL police headquarters lockup on May 21.

The number of custodial deaths since 2000 is 219, a shocking figure that is sure to rise without any safeguards and preventive mechanism such as the IPCMC. There is no reason why the BN Federal government refuses such oversight of the police when it is recommended in 2005 by the Royal Commission of Inquiry into the Police.

Malaysians are shocked by the serial repetitions of custodial deaths that continue to occur despite assurances from BN Federal government Ministers that there will be safety and protection measures in place for detainees. Even former Inspector-General of Police (IGP) Tan Sri Musa Hasan said that he had not opposed the IPCMC when he was the IGP, provided that the police had a right to appeal to courts against the decisions made by IPCMC.

Whilst some of the custodial deaths may be due to natural causes, the public will continue to have grave suspicions in police interrogation methods unless the police can assure the public that they are not only clean, but are seen to be clean. The public have lost hope in new Home Minister Datuk Seri Ahmad Zahid Hamidi, who clearly lacks urgency in protecting human rights and preventing custodial deaths as well as is completely disinterested in fighting crime but is more focused on using harsh and oppressive methods to silence any political dissent to protect BN.

Only a transparent and accountable mechanism which is available by establishing the IPCMC, can restore public confidence and reassure the public that detainees in police custody will be safe. Otherwise, the public will have recurring nightmares that should any of their loved ones be placed in police custody, they may not walk out alive.

• 占姆斯于5月26日死于槟城警局扣留所;

4 Challenges For Sarawak DAP In The 2015 State General Elections (en/cn)

Speech By DAP Secretary-General And MP For Bagan Lim Guan Eng During The Sarawak DAP State Ordinary Convention In Kuching On 9.6.2013.

4 Challenges For Sarawak DAP In The 2015 State General Elections

1. First of all, I would like to congratulate Saudara Wong Ho Leng and acknowledge his leadership in once again breaking new ground for DAP in Sarawak in the recently concluded 13th General Elections.

2. DAP Sarawak followed up its historic 2011 Sarawak State elections performance, where we won 12 out of the 15 Pakatan state seats, by winning 5 out of the 6 Pakatan parliamentary seats in the 13th GE.

3. A most remarkable victory was achieved in the Sibu parliamentary constituency, where our Saudara Oscar Ling, achieved the seemingly impossible by increasing our winning majority from 398 in the 2010 by-election to 2,841! Not only did he increase our winning majority more than 7 fold, he did this against Lau Lee Ming, a Temenggong, no less, and also a family member of the powerful KTS group in Sibu.

4. Under Saudara Wong Ho Leng’s leadership, DAP also managed a clean sweep in the Sibu area by winning Sarikei by 505 (Saudara Wong Ling Biu) and also Lanang by 8,630 votes (Saudari Alice Lau).

5. In Kuching, Saudara Chong Chien Jen successfully increased his majority in Bandar Kuching from 9,952 in 2008 to 19,642 in 2013. Under his leadership in Kuching, we also managed to capture the Stampin seat with an 18,670 vote majority. This was a seat which we had lost by 3,070 votes in 2008. Our candidate in Stampin, Julian Tan, who is also a new comer, defeated a SUPP heavy weight and Deputy Minister, Yong Khoon Seng.

6. We also broke new ground in many non-Chinese and non-urban areas. For the first time in DAP’s history, we fielded 6 non-Chinese candidates in 6 non-Chinese majority districts. In fact, DAP fielded more non-Chinese candidates compared to Chinese candidates (6 versus 5) in GE13! And in 4 out of these 6 parliament seats, we managed to reduce BN’s support even though we did not managed to win these seats.

7. Mordi Brimol in Mas Gading, Edward Luak in Serian, Hai bin Merawin @ Bonaventure in Mukah, Ramli Anak Malak in Kapit, Dr. John Brian in Bintulu and Dr Bob Baru in Lawas should also commended for putting up an excellent showing despite being outspent by at least 10 to 1 by their opponents.

8. Dr. John Brian, for example, together with deputy chairman, Saudara Chew Chin Sing, managed to decrease BN’s support by 15%, from 73% in 2008 to 58% in 2013.

9. I am confident that as we continue to work hard and penetrate into the semi-urban and rural areas in Sarawak, our performance can only improve especially in the next Sarawak state elections that are due in 2016.

10. DAP Sarawak now has 5 parliament and 12 state seats, a far cry from the 1 parliament and 1 state seat after the 2004 General Election.

11. To fully appreciate where we are today, we need to acknowledge the blood, sweat and tears that were spilled by those who had worked tirelessly on the ground without enjoying the fruits of their labour for many, many years. This includes Saudara Chong Siew Chiang, the founder of DAP in Sarawak, who first competed in the 1979 Sarawak state elections. He and other senior leaders of DAP Sarawak had to struggle through 4 state elections in 1979, 1983, 1987 and 1991 of not winning a single state seat.

12. It was only in the 1996 Sarawak state elections when the party made a breakthrough by winning 3 state seats, including Saudara Wong Ho Leng’s 226 vote victory in Bukit Assek. This was followed by the setback in 2001 where we only won one state seat. Another minor breakthrough was achieved when DAP in Sarawak won a then record 6 state seats in the 2006 general elections. And of course, we all know how DAP doubled its state seats on April 16, 2011 to a record 12 state seats.

13. Without the hard work and sacrifice of the party’s founding leaders in Sarawak, DAP would not be where it is today. Their struggles through the difficult times is a stark reminder that we can never be complacent and to take for granted our current position of strength especially in the urban areas. If we fall away from our principles, if we betray the trust of our voters, we can easily end up in the position which SUPP, MCA and GERAKAN find themselves in today.

Sarawak Problems Are Malaysian Problems – Where Is ‘1 Malaysia, 1 Price’?
14. While we must never forget our history and our roots, our challenges lay in the future. I foresee 4 important challenges for DAP moving forward in the state of Sarawak.

15. Firstly, DAP in Sarawak must rise up to the challenge of enhancing the party’s stature as a national party. This means that issues of concern to Sarawak must be seen as national issues and that national issues must also be seen and interpreted through a Sarawakian perspective. Sarawak problems are Malaysian problems.

16. We have already seen how allegations of massive corruption against the Chief Minister of Sarawak, Tan Sri Taib Mahmud, affects not just the good name of the state of Sarawak and its people, but it also tarnishes the reputation of the country as a whole. We have also seen how cases involving palm oil plantations in Sarawak not obtaining Roundtable on Sustainable Palm Oil (RSPO) certification can affect the reputation of the entire industry in the country.

17. When is the “One Malaysia, One Price” going to be effected? When is poverty going to be eradicated and Native Customary Land of native Ibans going to be respected. No longer is it acceptable to have the landless and poorest in one of the richest and largest state in Malaysia.

18. While fully accepting the co-equal status of Sabah, Sarawak and Peninsular Malaysia, we can no longer accept the false dichotomy between what happens in Sabah, Sarawak and Peninsular Malaysia do not affect one another. The notion that ‘whatever happens in Sarawak stays in Sarawak’ is clearly a false notion that has been propagated by the BN in order to scare Sarawakians into continuing to support the BN and the Sarawak Chief Minister, Taib Mahmud.

Polls Reform Of ‘One-Man, One Vote, One-Value’ Shall Not Reduce The Number Or Proportion Of Parliamentary Seats In Sabah And Sarawak But Serves To Reduce Unfair Disparities That Devalues Democracy Within Both States.
19. Secondly, we must continue to fight for electoral reform in the country and especially in Sabah and Sarawak. Tens of thousands of Sarawakians who are working in Peninsular Malaysia, but do not have the time nor the resources to go back home to Sarawak to vote have been effectively disenfranchised. Sarawakians who are living and working in Peninsular Malaysia, must be permitted to cast a postal ballot just like how Malaysians overseas who are already registered cast their votes as postal voters. Without this change, the turnout rate in Sarawak, which was 76% in GE2013, cannot be on par with turnout in Peninsular Malaysia, which was 86.5% in GE2013.

20. We must also fight for the ‘one-man, one-vote, one-value principle’ in the upcoming re-delineation exercise so that the unfair advantages enjoyed by the BN can be somewhat reduced. The last re-delineation exercise in Sarawak was completed in 2005. Eight years on, in 2013, it is possible that the Election Commission (SPR / EC) may want to conduct this exercise for Sarawak as well. If the Sarawak review occurs this year, then we must push for the size of the disparity between voters per seat to be significantly reduced.

21. Here I would like to stress that the present proportion of parliamentary seats allocated to Sabah and Sarawak shall not change, out of respect for the traditional rights of both states granted when they joined Malaya in 1963 to form the Federation of Malaysia. In other words, what we are seeking for is neither reducing the number of parliamentary seats nor reducing the proportion of parliamentary seats in a future enlarged Malaysian Parliament.

22. Regardless of the number of parliament and state seats which may or may not be added, the obvious examples of unequal distribution of voters in seats WITHIN Sarawak is already a great cause of concern and a violation of the ‘one-man, one-vote, one-value’ principle. For example, we can no longer sustain having Stampin with 84000 voters on the one hand and Igan with a mere 17,815 voters (ratio of 4.75: 1). The same applies to the state seats as well where the largest seat, Pending, has more than 30,000 voters while the smallest, Ba’kelalan, has only slightly more than 7,000 voters, a ratio of 4.3 to 1.

23. The focus here should be to reduce the size of these disparities. DAP appreciates that geography can be equally important as demography in a state as large as Sarawak. Accordingly DAP is proposing a special consideration of a maximum voter disparity between constituencies in both states of 100%, instead of the baseline 15% disparity that was in the original Merdeka Constitution of 1957 for Peninsular Malaysia.

Kick-off For The 2015 Sarawak General Elections
24. Thirdly, we must kick off the next new phase by preparing for the coming state General Elections expected in 2015. Even though there is 2 years more to go, we have to strengthen our machinery into rural areas in a non-threatening and more persuasive manner. The important issues will again revolve around BN’s mercenary rule where resources are reserved for the few and when will Tan Sri Taib Mahmud retire as promised in the 2011 state general elections. The new Sarawak DAP Committee will be required to submit their election plans and preparation to the CEC.

25. DAP Sarawak has already announced that it will plan to work the ground in an additional 23 non-Chinese majority seats in preparation for the next state general elections. We will be asking all DAP ADUNs and MP, especially the 128 non-Sarawak MPs and ADUNs, to actively assist in the rural areas to break down and dismantle Taib Mahmud’s and BN’s rural domination.

PR’s Ideals, Principles And People-Centric Policies Can Bring A Better Future.
26. Fourthly, we must focus of ideals, principles and people-centric policies to counter corruption, privileged interests and cronyism. Our challenge is to show rural Sarawak that our policies will make a positive difference in their lives. Rural Sarawak must be fully aware of the benefits of DAP’s proposed RM1 billion Dayak Endowment Fund. Many do not know how change matters and can make a better future for their children.

27. Whilst the 2013 general elections is an urban tsunami covering all races whether Malay, Chinese, Indian, Kadazan or Iban, including Sarawak, we have to instill courage, Malaysian goodwill and hope to dispel the hatred, fear and even violence perpetuated by BN. For Sarawakians, the question is even more pressing to ensure that Sarawakians receive a fair share of their natural resources such as increasing the oil and royalty from the present miserly 5% given by BN’s Petronas to 20%.

28. If DAP in Sarawak and in the rest of Malaysia can rise up to embrace these 4 challenges, I am confident that Sarawak will play a key role in ensuring that Pakatan wins a simple majority in the next general elections, in GE14. The key to opening the GE14 door is for Pakatan to break new ground in the 2015 Sarawak state elections as a precursor to Pakatan winning power in Putrajaya.

29. Deputy Prime Minister Tan Sri Muhyidin Yassin is going on a rampage to punish those who support PR, especially the Chinese community. This makes a mockery of democracy as people should not be punished for making a free choice. If PR can treat everyone fairly in the states we rule, why can’t BN behave like a Malaysian, and not like a bad bully that continues to discriminate and take political revenge?

30. The only alternative to have a bright future for Sarawak and Malaysia is to change the BN government. Let us prove that the power of the people is more powerful than those people in power. Have a good State Ordinary Convention and good luck to those elected leaders. You have a lot of work to do. Thank you.

Excerpt from my new short film, SPRINGTIME NOSTALGIA 残香

A new short film of mine, SPRINGTIME NOSTALGIA, is premiering at next week's Shanghai International Film Festival, followed by a screening at the Taipei International Film Festival in early July as part of an "in focus" program for actress/producer Kiki Sugino.

This Ikebana-themed short that was commissioned by Kao last year

The kind folks of Taipei International Film Festival posted a one-minute excerpt of the short film on Youtube which featured the three main cast members, Kiki Sugino (who did EXHALATION with me back in 2010), Qyoko Kudo (who did KINGYO with me back in 2009) and Eriko Ono (who was probably a baby when I collaborated with the aforementioned two actresses in my previous works).

I really liked the synopsis that they have written in Chinese.

My (crappy) translation:

A man who loved Ikebana once asked: "If I were to disappear one day, will you look for me?"

After he disappeared, the woman loses her sense of smell. The woman goes to an Ikebana class, the teacher notices her flower arrangement and is shocked, she asks the woman who had taught her this arrangement.

The woman remembers the man and wonders: "If we were to meet again, what will he remember?"

Beautiful and poetic imagery, it is as if these vivid colours were trying to conceal a piece of missing memory.

Sometimes, I feel that these film festival synopses are cooler than my actual films.

Mahathir should be a model Malaysian and not be a stereotypical racist in the evening of his days

Former Prime Minister, Tun Dr. Mahathir Mohamad has shocked and outraged many Malaysians with his recent conduct where both during and after the 13GE, he had been one of the most extremist and racist voices in the country. In the evening of his days, Mahathir should be a model Malaysian instead of being a stereotypical [...]

DAP leaders and members to start preparing for the 14th General Elections with two-fold objective – to effect change both at the Federal and Sabah state government levels

Sabah did not achieve our Pakatan Rakyat objectives of winning at least one third of the 26 parliamentary seats in Sabah so that in the three “fixed deposit” states of Sabah, Sarawak and Johore, PR can win 33 parliamentary seats to help Pakatan Rakyat to provide the final cluster of parliamentary seats to win Putrajaya [...]

You might not have heard of the Japanese writer Mieko Kanai (金井美恵子), but she wrote the short story "The Moon" that inspired my short film "LAST FRAGMENTS OF WINTER".

I stumbled upon her works by accident. It was September 2010. My uncle (father's younger brother) passed away suddenly, my parents, who were in Tokyo with me for my graduation ceremony, had to fly back to Malaysia immediately.

I was left alone in the hotel that my parents were supposed to stay for a few more days. Overwhelmed by solitude, I went to my favourite Aoyama Book Center in Roppongi, hoping to distract my mind with literature.

Going through the shelf, "THE WORD BOOK" by Mieko Kanai, a collection of her short stories, caught my eye. Maybe it was the cover. THE WORD BOOK came out in the 70s, but it only just got translated into English that year.

THE WORD BOOK by Mieko Kanai

I flipped through the book, went through some stories, and found myself captivated by the imagery of her dream-like tales. I didn't buy the book immediately, but her words lingered. (I bought the book a few days later on Amazon)

This is the opening paragraph of "The Moon":

According to Mother, I was already old enough to go on errands all by myself, even at night. "The chicken butcher and the green grocer just in front of it, near the castle at the edge of the shopping area, should be open till nine, and I want you to get me a chicken and a package of mushrooms there, I'm sorry you have to go at night like this, but I couldn't say no. "Your older sister" - she had died at age six - "used to take a little wicker basket and go buy the enriched powdered milk she always drank," Father said, laughing good-naturedly; but Mother looked a bit sad. Then I went out into the town, where the last dim twilight had been swallowed up in night."

Another one:

Oddly enough, our accounts of our memories of the dead begin with the arrival of news of a sudden death. When this call comes, we are dazed, left speechless. Those who were close to the dead person may have the impression of things occurring in a dream whose meaning is out of reach. Like words heard in a dream - or rather, in a dream one was trying to recall while only half-awake..

What was sad, in what words? We have no idea. There are only traces of the raw reality of having been informed of something truly frightening. One's very irritation of being unable to recall the significance of words spoken in a dream feels like something that is happening in yet another dream, a nightmare. Thus, confronted with news of a sudden death, they (I) feel vertigo. Then they start to talk about you, who have already turned into a memory - about their memories of you, which are somehow lacking in reality. They emphasize the fact that you are no longer in this world as they speak of you, so the memories all become beautiful, taking on a tragic tone. Even the most boring memories are enveloped, in this place, in deep, tragic shadows.

And finally:

When I got home, I found everything just the way it had been when I left, with Mother lying on a rattan chaise-longue in her usual place in the sitting-room, listlessly reading a book with a russet cover. When she saw my face, she looked a bit angry and said, "Where were you off to, young man? I was afraid you'd been kidnapped and would never come back!" I started to open my mouth to explain what I had seen, but I was in the grip of a melancholic fretfulness and couldn't say a word. Then Father spoke: "You were looking at the moon, weren't you?"

I blinked and just said "Unh" in reply. father took the packages of good, saying, "It'll take thirty minutes to cook the chicken, so go take your bath, you're big enough to wash yourself now, but I'll wash your hair for you."

It was after that Mother died, though I don't know if it was a year after, or a month, or a week, or a day.

The story shifted from the point of view of a child, and then to an adult, I wasn't sure whether it was the same person, or whether it was told from the perspective of the child and his father.

A few months later, I made LAST FRAGMENTS OF WINTER, because I needed to get these images out of my system. It usually happens this way. (my earlier short films, LOVE SUICIDES and KINGYO, were loose adaptations of Yasunari Kawabata's short stories as well)

Retyping the words from "The Moon", I am mildly surprised by how faithful I had been to the source material.

Two years after that, right now, I became a part of James Lee's HUNGRY GHOST FESTIVAL: 3 DOORS OF HORROR omnibus, I find myself, once again, drawing from the Mieko Kanai pool of inspiration, this time, it's from the short story "The Boundary Line" (also from "THE WORD BOOK"), which revolves around a drowned female corpse. The other two directors, Ng Ken Kin and Leroy Low have finished their segments (Leroy finished his shoot just a few days ago), both will most probably be great, so I'm now preparing for my shoot (scheduled at the end of June). Yesterday, I have secured most of the key cast members for the film. Soon, I will continue revising the script to see what is there to fix. I usually work on my script until during the shoot itself.

Going through the "THE WORD BOOK" again, I realized that another Kanai book "INDIAN SUMMER" had just gotten translated earlier this year. This book review is written by Paul McCarthy (who was the translator of THE WORD BOOK!).

Through this review that I found out Mieko Kanai had been living in Mejiro for decades, the very same area that I've stayed in for the past five years.

The Last Train: Mejiro, Tokyo, Japan

Sunrise at Zoshigaya

The fact that she's in the neighbourhood made me wonder whether this is the reason her works resonated with me.

Istilah ‘dakwat kekal’ tipu pengundi, kata Dr Haron Din

Harakah Daily

Perhimpunan aman saya sokong,” jelas beliau.

Malaysians Have No Faith In Paul Low’s Long-Term Solutions Or Paradigm Shifts To Fight Corruption (en/cn)

Press Statement by DAP Secretary-General and MP for Bagan Lim Guan Eng in Kuala Lumpur on 8 June 2013.

Malaysians Have No Faith In Paul Low’s Long-Term Solutions Or Paradigm Shifts To Fight Corruption When He Refuses To Fully Commit To Implement Institutional Changes Such As Setting Up The Independent Police Complaints and Misconduct Commission (IPCMC) To Prevent Custodial Deaths, Implement Public Declaration Of Assets By Government Leaders And Open Competitive Tenders.

Paul Low can not blame Malaysians for thinking that all his rhetoric about transparency and accountability are merely “cosmetic changes” when he has changed his tune from his position as Transparency International Malaysia Chairman calling for open competitive tenders and public declaration of assets by government Ministers. As long as Paul Low is willing to commit himself to the institutional changes mentioned, then the people are willing to give him not just 100 days but 100 weeks. Of course Paul Low has to resign if they are not fulfilled.

DAP fails to see what long-term solutions can be found by Paul Low or even whole paradigm shifts that can address the root causes of corruption without the institutional changes of setting up the IPCMC, implementing open competitive tenders and public declaration of assets. Instead Paul Low has turned apologist for BN and even rapidly adapted to BN’s culture of lies by justifying that personal safety of Ministers and their families as the reason why there can be no public declaration of assets.

Penang is a very good example of how such public asset declaration and open competitive tenders have not caused problems but brought about benefits since 2008, in terms of yearly state budget surpluses, reduction of the state government debt by 95% and increase in our asset reserves by 50% to RM1.2 billion.

Paul Low’s refusal to commit himself and set a time frame for these institutional changes has gravely eroded not just his but also indirectly Transparency International’s public credibility. There is no reason why Paul Low cannot press Cabinet to form the IPCMC immediately when even former Inspector-General of Police (IGP) Tan Sri Musa Hasan said that he had not opposed the IPCMC when he was the IGP, provided that the police had a right to appeal to courts against the decisions made by IPCMC.

UMNO’s arrogance of power will backfire

hamlet-and-horatio-before-the-grave-diggers-1843(1)

When Hamlet bemoans “the oppressor’s wrong…, the law’s delay, the insolence of office”, it is a classic case of art imitating life. Except that in our present condition, the powers that be are seeing it fit that life should imitate art.

So, as last week’s events have shown, in re-arresting Tian Chua, Tamrin Ghafar, and Haris Ibrahim just four days after they were freed by the court, the police plainly displayed ‘the insolence of office’ and showed utter contempt to the magistrate who had ordered their release.

Prosecuting them as well as other activists and opposition leaders for activities linked to the “Blackout 505” rallies therefore adds to ‘the oppressor’s wrong’ and nails the lie on Najib’s ‘reform agenda’ so proudly proclaimed not just to the nation but the world at large.

The custodial murders of Kugan, Dhamendran and others speak for themselves in the brutality and horror of the crimes and the audacity of those responsible for the initial cover-up, notwithstanding that some of the killers are finally charged.

Deporting Nurul Izzah from Sabah as if she were a common felon and placing Lim Kit Siang, Ambiga and me on the persona non grata list are yet other instances of the shameless abuse of power. That the bar was subsequently lifted is immaterial because the damage had already been done since she could not be there in time to celebrate a major cultural event with the people of Sabah.

They may claim some ‘technical right’ to arrest prior to charging suspects, power to interrogate, unfettered power for the Attorney General to prosecute whom he so wishes or some legal provision which allows the powers that be to bar citizens from entering Sabah. But when such a right or power is exercised without regard for human dignity, what more for the sanctity of life, it is not rule of law but tyranny and oppression. More profoundly, these acts and many more that have been committed have demonstrated the chilling and insidious consequences of the arrogance of power.

Under what circumstances are we that a mere presumed legal right can be used to justify dumping innocent people in the lockup to spend the night just to make life easy for the police to have them charged before a court of law?

Some will say this is making a mountain out of a mole-hill. But is it? To my mind, this liberty is inalienable and no words suffice to describe its import to the dignity of the person.

King Lear may tell Cordelia: “Come, let’s away to prison; We two alone will sing like birds in the cage” but that’s on a mystical level. And at that stage, Lear’s already insane. You may get used to the damp wall and the hard bed or even the stale bread but as long as your mind is clear, your spirit will never come to terms with the deprivation of your liberty.

In making the needless arrests, and then using the Sedition Act after having promised the nation it would be repealed, Najib Razak has ridden rough-shod over the urgings of the people – of lawmakers, civil society leaders and other community leaders – and have now in one fell stroke sealed the wall of alienation with the people. He’s also proven once again that he is not an honorable man.

That is why the prosecution of P. Uthayakumar for sedition – as well as the others – is significant in showing up the farcical nature of Najib’s government. That the reality never matches the rhetoric; that the promises are left on the wayside; and that when unchecked the ‘oppressor’s wrong’ can multiply many fold, eroding the foundation of our fundamental rights and tearing the fabric of our dignity as free citizens in a sovereign nation.

No doubt by refusing to continue with his defence, Uthayakumar had chosen to take the moral high ground for the cause he believes in and this has landed him a jail sentence far in excess of the supposed ‘crime’. But it needn’t have gone that far had the Attorney General used his prerogative to issue a nolle prosequi, that is, to discontinue the trial.

But all roads to accountability must lead to the man who wants to be Prime Minister. Indeed, “the oppressor’s wrong…, the law’s delay, the insolence of office”, are symptoms of a deep-seated systemic breakdown of the institution of governance.

So, let me remind not just Najib but Mahathir, Daim, the oppressors, and their co-conspirators, the words of Martin Luther King, Jr.: “Injustice anywhere is a threat to justice everywhere…. Whatever affects one directly, affects all indirectly.” Slowly indeed the wheel of karma turns around its axis but those who commit wrongs and injustice will sooner or later be brought to account.

The brazen show of arrogance is matched only by the bias in the handling of real mischief makers, the hate mongers and racist provocateurs. The failure to take action against these criminals speaks one thing and one thing only: that this country has two sets of laws, one favouring UMNO and its cronies and another against law abiding citizens whose only ‘crime’ is to fight for their rights, for justice and for a legitimate government through free and fair elections.

Make no mistake. This arrogance of power will backfire. It will not succeed in dampening the spirit of the people. They can jail us, deport us, intimidate and even humiliate us, but the courage and the will of the people shall never be defeated. That’s because real power resides in the people. As Malcolm X once said, power in defence of freedom and if I might add, of justice and of our dignity, “is greater than power in behalf of tyranny and oppression.”

DAP will establish “Ubah Networks” overseas to reach out and articulate the concerns of overseas Malaysians, appoint DAP Vice-Chair Teresa Kok as Selangor Government Political Liasion Officer, and the 3 Selangor State Government PR Leadership Council Members for DAP Are Tony Pua, Teng Chang Khim and Gobind Singh Deo. This was decided at the DAP Central Executive Committee meeting on 5 June 2013.

The meeting focused on the relentless attacks by the Registrar of Society(ROS) in complicity with the BN-controlled media especially New Straits Times and Utusan Malaysia to demonise the DAP with lies of irregularities and illegalities in DAP’s National Congress to set the ground for deregistering the DAP. The DAP CEC unreservedly condemns BN for framing up a lie that no notice was sent to over 700 delegates when all notices were sent.

Even the ROS’ letter of enquiry on failure to send notices referred only to 4 branches with less than 15 delegates, NOT over 700 delegates. And 3 out of the 4 branches had sent delegates to the DAP National Congress in December last year. DAP will remain steadfast to vigorously defend the status of the party in and outside courts following BN’s attempt to win dirty by deregistering the DAP after suffering a comprehensive defeat in the 2013 general elections. 2 BN state candidates in Penang lost their election deposit to DAP for the first time in general election history.

Not only did BN lose to DAP in the 2013 general elections with DAP winning 38 out of the 51 parliamentary seats and 95 out of the 103 seats contested but PR also defeated BN by winning the popular vote for the first time in history with 51% against BN’s 48%. BN is seeking vengeance by trying to illegally deregister the DAP with baseless lies and prosecute PKR, DAP and PAS leaders with frivolous charges in court to disqualify our elected representatives.

The DAP CEC also reaffirms that the 2013 general election results is not a Chinese tsunami but a Malaysian urban tsunami of all races against BN. DAP not only had elected representatives who are Chinese, Indians and Malays but also won in a Malay majority constituencies such as Mentakab with 52% Malays, 40% Chinese , 6% Indian, 2% Others and Raub with 50% Malays, 40% Chinese, 6% Indians, 2% Others.

Clearly for BN leaders to racialise the election results is not only irresponsible and dangerous but shows their true ugly face of extremist racist ideology promoted by Nazi leader Aldolf Hilter and South African apartheid regime.

Ubah Networks

The DAP CEC will also establish Ubah Networks to reach out to the 500,000 Malaysians overseas, especially Singapore, Europe, America, Australia and Asia-Pacific. This Ubah Network will be headed by DAP International Secretary and MP for Batu Gajah V. Sivakumar and the office-bearers will be announced later. The importance of Malaysian overseas has gained importance following the concession by the Election Commission to allow overseas voting at the Malaysian Embassies and High Commission during this general elections.

Unfortunately, the voter turnout was not encouraging. In Great Britain with nearly 80,000 Malaysians, only 1,200 Malaysians voted at the Malaysian High Commission in London. There is much more room to gain support from the 500,000 Malaysians overseas who are eligible to vote but did not vote .

Selangor
The DAP CEC proposes that DAP National Vice-Chair Teresa Kok will hold the same position of Political Liasion Officer to the Selangor state government similar in status and terms to the appointment of PKR Secretary-General Saifudin Nasution. Teresa’s proposed appointment is to ensure parity and that DAP is an equal partner in the PR state government. In that respect, PAS should also have one Political Liasion Officer.

As for the three DAP Selangor state representatives to the Selangor State Government PR Leadership Council to resolve all people-centric issues in the state government, the DAP CEC has appointed Sdr Tony Pua, Sdr Teng Chang Khim and Sdr Gobind Singh to the 10-man council chaired by Selangor Menteri Besar Tan Sri Khalid Ibrahim.

Rangkaian Ubah (Ubah Networks)

To Rent or Not To Rent?

ForRentTo rent or not to rent?  The answers can be quite straightforward in certain cases but uncertain in others.  If you are thinking of staying in one place but not planning on settling down in that place for the long term, renting is a clear choice.  Renting offers the advantages of mobility, lower initial costs and lesser responsibilities.

You can move anytime when a new job forces you to relocate.  As a renter, you also have fewer responsibilities as you do not worry about maintenance or repairs.  If you desperately need a place to live but have limited funds to buy a property, renting makes sense.  Later, when you have sufficient funds to own a property, you can switch to becoming a homeowner instead of a renter.  There are several factors you need to consider before deciding on a place to rent.

Location

  • Is it situated in your preferred location?
  • Is there a good public transportation system in placed?
  • Are there any shops, schools, clinics, etc., nearby?
  • What about security – is the place safe with no records of bad incidents within the neighborhood?
  • Who are your neighbors -  small or big families or young working adults?

Renting costs

  • How much is the rent?  Is it within your budget?
  • How long is the lease?
  • Can you sublet the extra room?
  • How much deposit do you need to pay?

Condition of the place

  • Check the building exterior – is it well maintained?
  • Are there parking facilities and recreation areas provided?
  • What about the interior – is it clean and habitable?
  • What are the furnishings included in your rental?  Do you need to bring in or buy new things to furnish the place?

Well, different people will have different priorities when it comes to choosing a suitable place to rent.  If your main concern is the rental costs, you’ll be motivated to look for the cheapest rental you can afford.  If what you want is a place near your workplace, you’ll be looking for a place that will save you on transportation costs and presents minimal commuting hassles.

SAMSUNG GALAXY NOTE 2 AMBER BROWN

Mobile phone colours had always been pretty standard with either black or white body. Not only mobile phones, but other electronic devices too! This makes it unfair for those people who love other colours as they were left with no choice but to choose a pre-standard colour. However, Samsung has always been hearing out customers’ opinion and requests. They’ve recently launched the Samsung Galaxy Note II in Amber Brown colour, specially for those people who seek for strong, elegant yet comforting and down to earth.

note 2 brown SAMSUNG GALAXY NOTE 2 AMBER BROWN

Samsung Galaxy Note II has been a pretty hit in stores around the world and definitely it is an impressive phone from Samsung. With such a great phone, it became even greater as it is now available not only in standard colours but with Amber Brown as well. For those who seeks for a serious, organized yet strong and elegant looking phone, the Samsung Galaxy Note II Amber Brown might be the phone you’re looking for.

Note+II+Brown+Ad SAMSUNG GALAXY NOTE 2 AMBER BROWN

In conjunction with the new colour, I also made a short video about a guy (Vincent) and a girl (Careen) who had been childhood friends since primary school. The guy’s favourite colour is brown and he likes everything brown. The girl prefers white but instead of despising the guy’s choice of colour, they maintained really good friends (or rather best friends forever if you would call it) even as time goes by from young to teenage and then working adult. Nothing beats a love like friendship.
